Filing for child custody doesn’t have to be completely overwhelming or stressful. You don’t need to spend a lot of time worrying about the process–especially because you have so many other things to think about. Here are some basic steps to simplify filing for child custody.
1. Discuss your case with legal counsel. Before you decide if you want to hire an attorney, sit down and talk with one. You can discuss your case and ask some questions about representation. This should give you a good idea if you need a lawyer.
2. Decide if you want an attorney on your case. Depending on your situation you may or may not decide you need a lawyer. If you do want an attorney, look around and find one that works well with you and that you feel confident in.
3. Pay a visit to the court. Go to the courthouse where you file (it’s the same court where you file for divorce) and talk to the people there. They can give you information about the papers you need to file and specific steps to take.
4. Fill out the paperwork. Figure out what papers you need to fill out and take the time to get all of the right information. If you are the first parent when filing for custody you fill out one set of papers and if you are responding you fill out another set.
5. Come up with your custody agreement. You need to think about what your custody and visitation schedule and the other issues in your agreement. Some of the papers you fill out will ask for this information and the rest of the information you need so you can be prepared.
6. Find sources of help. You will have questions along this process–look everywhere you can for answers. There is information online, at the courthouse, in support groups, and other places. You can find the answers you need.
Throughout all of this, try to remain positive. It can be easy to get overwhelmed–but take things day by day and you’ll get through it. Focus on the end when you’ll get to spend the time you want with your child.
